You have 2 main options:


1) Have a lawyer draft a Power of Attorney for you - recommended.


2) Draft your own Power of Attorney and take your chances.


If the latter, and you draft your own documentation,  be advised that you're taking your own chances regarding the form, content and execution formalities of the Power of Attorney. Do-it-yourself Powers of Attorney leave you with no insurance against your own mistakes. If you decide to do-it-yourself, be forewarned that doing so is not a substitute for the assistance of a lawyer.

Manitoba Legislation (statute/law):

A Power of Attorney helps to Protect yourself and your Family in the event that you lose mobility or mental capacity. Ensuring help is available with management of your affairs regarding the agencies, facilities, service providers and businesses that may require a Power of Attorney.

A Legal Will helps to Protect yourself and your Family by helping to ensure that the right people are provided for when you pass on.

A Few things to point out:


1.  Don't wait too long. It sounds obvious but, it's not. A person has to have mental capacity to sign a Power of Attorney. It's best not to leave to the last minute. We get phone calls every week of an emergency nature because people have waited too long. Contact us whether you're in Winnipeg, a surrounding area or, out -of-the-Province.


2.  A Power of Attorney is not a Will. A Will comes into effect once a person has passed. A Power of Attorney is in effect while a person is a alive. Each is a separate document.


3.  A Heath Care Directive is another separate document. You can nominate a "proxy", a person who will make health care decisions for you but, this is not done within a Power of Attorney. In Manitoba, there are 3 separate Acts or "laws" that govern. The Powers of Attorney Act, The Wills Act and the Health Care Directives Act. For each a Power of Attorney, Will and/or Heath Care Directive, you require a separate document.
